CONGO License

The CONGO application is available under the following licensing arrangements.

Background
CONGO was developed with support from Gaming, Fandom, and Science Fiction organizations. Because of this support, those organizations have special license rights to the CONGO system. See the ORGANIZATIONS definition below.

Definition of Terms
CONGO refers to the application server, web client (Coconut), and all associated tools, structures, documentation, and utilities distributed under the 'CONGO' product name.

An EVENT is a single convention, meeting, or other type of gathering that may occur once or multiple times a year. If an EVENT happens multiple times in a single year, each EVENT is considered separately.

An ORGANIZATION is a single group or registered company in the position of managing, interacting with, or supporting a specific EVENT, and falls into one of two categories:

• Non-Profit SF, Fandom or Gaming organization
• Any other organization

Determination of which category an organization falls into is at the sole discretion of Stonekeep Consulting.

Licensing Rights - Fandom organizations
If an organization is identified by Stonekeep Consulting as a purely Fandom organization, they have the right to download, compile, modify, and use CONGO and it's source code for their event, subject to the restrictions listed below. Fees for this situation may be waived.

Because Fandom organizations have access to the source code for CONGO, they are restricted from redistributing the source code or keys to parties outside their particular organization.

Licensing Rights - All other organizations
Any organizations not identified as a Fandom organization may download the CONGO binary distribution, and must obtain a key from Stonekeep Consulting in order to use the software. Stonekeep grants the right to these organizations to download, use, and market CONGO for their event, but they may not distribute the key or reverse engineer the system in any way to allow redistribution of the CONGO without requiring a new key to be issued.

WARRANTIES; LIMITATION OF LIABILITY; INDEMNIFICATION.

Licensee agrees that it shall comply with all applicable laws and regulations, including all U.S. and foreign export control laws or regulations. Licensee acknowledges that Software may be subject to regulation by agencies of the U.S. government, including the U.S. Department of Commerce, which prohibit export or diversion of certain products, technology and technical data to certain countries.

STONEKEEP CONSULTING AND THE THIRD-PARTY LICENSORS PROVIDE THE SOFTWARE AND DOCUMENTATION "AS IS," AND WITHOUT WARRANTY OF ANY KIND (EXPRESS OR IMPLIED). STONEKEEP CONSULTING AND THE THIRD-PARTY LICENSORS MAKE NO, AND HEREBY EXPRESSLY DISCLAIM ANY, WARRANTY IN CONNECTION WITH THE SOFTWARE AND DOCUMENTATION, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTY RELATING TO THE CONTINUOUS, UNINTERRUPTED, VIRUS-FREE, OR ERROR-FREE OPERATION OF THE SOFTWARE.

UNDER NO CIRCUMSTANCES SHALL STONEKEEP CONSULTING BE LIABLE TO LICENSEE FOR ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE SOFTWARE, DOCUMENTATION, OR THE SUBJECT MATTER OF THIS AGREEMENT, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF THE OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, SUCH AS, BUT NOT LIMITED TO, LOST REVENUE, PROFIT, OR BUSINESS OPPORTUNITY; OR INTERRUPTION OF USE OR SERVICES.
